Terms and Conditions of Letting for Mornacott Cottages effective for all new bookings made after 8th January 2021.

THE CONTRACT
The Contract for a short-term holiday rental will be between Mornacott Cottages (referred to as "us", "we", "our") and the person making the booking and all members of the holiday party (referred to as "you", "your", "guests") under the following booking conditions. English Law will govern the Contract. The Contract will be subject to these booking conditions, and must be complied with. The person whose name is on the booking form (referred to as the "Responsible Person") agrees to take full responsibility for ensuring that all the following Terms and Conditions are adhered to by all members of the party. The Responsible Person must personally stay at the accommodation throughout the holiday and be at least 18 years of age at the time of booking. The names, addresses and ages of all members of the party must be shared with us on request.

When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between you and us. A contract shall only arise when your booking is subsequently confirmed by post or email.

This agreement is made on the basis that the property is to be occupied by you for a holiday as mentioned in the Housing Act 1988 Schedule 1 paragraph 9 and the Holidaymakers acknowledge that the tenancy granted by this agreement is not an assured tenancy and that no statutory periodic tenancy will arise when it ends.

You undertake to use the property solely for its purpose as self-catering accommodation and to accept the Owner's right to refuse access to the accommodation to any person, whether the Responsible Person or guest of the Responsible Person, deemed unsuitable. Causing a nuisance or disturbance to neighbours or any unreasonable behaviour may result in the Owner requiring the Responsible Person or their guests to leave Mornacott.

PAYMENT
Bookings are confirmed on receipt of the booking form and receiving the deposit of 35% of the holiday cost. The balance of the rental will be due for payment 60 days before the arrival date; you will be sent email notification that the balance is due. If your payment has not been received 60 days before the commencement date we will assume that you wish to cancel. If the booking is made within 60 days of the arrival date then payment will be due in full.

No entry to properties will be allowed without payment, in full, being cleared beforehand.

CANCELLATION
Cancellations must be immediately notified to us by email following any occurrence giving rise to the need to cancel (delay in advising us of the need to cancel may result in us being unable to re-let the property and prejudice any refund that we may be able to make to you).
Notwithstanding the terms below a full refund of lodging costs will be provided in the event of the following:-

  • The UK Government declares a National Lockdown banning travel for the purposes of a holiday.
  • Travel is banned by law from the area from which you are due to travel (as evidenced by the address on your booking)
  • Travel is banned by law to the area of Devon in which we are located

We offer Flexible Cancellation which reduces the stress and worry from booking your holiday. You can cancel your Booking and obtain a refund of the lodging costs on the following basis:-

Up to 60 days prior to arrival: a full refund of lodging costs
From 59 to 30 days prior to arrival a 50% refund of lodging costs
From 29 to 15 days prior to arrival: a 25% refund of lodging costs

Partial refunds: where we are able to re-let all or part of the period in which you were to stay we will arrange for you to be refunded the amount received by us up to the extent of your loss (this may be a reduced sum given the last minute nature of any re-letting) less any associated costs incurred.

We strongly recommend that you take out travel insurance to cover your cancellation and other risks. This will give you the peace of mind that you will get your money back if you need to cancel your holiday. If you choose not to then you accept responsibility for any loss that you may incur due to your cancellation.

CIRCUMSTANCES BEYOND OUR CONTROL (FORCE MAJEURE)
If for any reason we have to cancel your booking in advance due to circumstances beyond our control for example fire, flood, destruction/damage to the property ("force majeure") you will be refunded the full amount of the booking. If we have to terminate your holiday early for the above reasons you will be refunded part of the lodging costs based on the time remaining of the booking. This will be the full extent of the liability of the Owners. No additional compensation, expenses or costs will be payable.

LIABILITY
As far as the law allows, Mornacott Cottages, its employees and representatives shall not be liable to you or your party for loss, damage or injury to you or any of your party or your/their property or vehicles as a consequence of this agreement or the occupancy following thereon.

You indemnify Mornacott Cottages against loss, damage or injury sustained to the property or any persons as a result of any breach of these conditions or arising from the fault of you or any member of your party.

RIGHT OF ENTRY
We shall be allowed reasonable right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

ACCURACY OF DETAILS
The brochure and website are as accurate as possible but cannot be warranted, nor do the descriptions form any contract. Whilst every effort is made to ensure accuracy of property descriptions and images, the facilities and services may alter. We reserve the right to alter or improve any of the subjects without notice.

TERMS OF USE
You may access the property from 16.00 on the day of arrival (earlier arrivals are strictly by arrangement only). Please note that departure is by 10.00 on your final day (again, later departures are strictly by arrangement only). We need this time to ensure that the cottage is ready for your arrival after the previous guests. On departure, you are requested to leave the accommodation in a clean and tidy condition. This includes washing up, dishwasher emptied, placing rubbish in bin liners and putting in outside bins, ensuring ovens and barbecue are clean and free from grease. We reserve the right to make a charge of £50 for extra cleaning if the accommodation is not left in a satisfactory condition.

NUMBER OF PERSONS USING THE PROPERTY
Under no circumstances may more than the maximum number of persons stated on the mornacott-cottages.co.uk website occupy the property. We reserve the right to refuse admittance if this condition is not observed. Guests must use the beds provided and camp beds and inflatable mattresses are not allowed. Any persons other than members of your party must not use the facilities at Mornacott.

STAG AND HEN PARTIES
Regrettably stag, hen or large single sex parties are not accepted.

CARE OF THE PROPERTY
You are responsible for the property and are expected to take all reasonable care of its furniture, pictures, fittings and effects, in or on the property. You must leave them in the same state of repair and in the same clean and tidy condition at the end of the rental period as at the beginning. You undertake to leave the property secure if left unoccupied during the period of let. You must not use the properties for any dangerous, offensive, noxious, noisy, immoral activities or carry on any act that may be a nuisance or annoyance to the owner or other neighbouring properties.

DAMAGES & BREAKAGES
You are legally bound to reimburse us for replacement, repair or extra cleaning costs on demand (although we would not charge you for the odd glass or plate). If you lose a key we will replace it upon you paying for the cutting of a new one.

FORFEITURE OF RIGHT TO OCCUPY
The Holidaymakers right to occupy the property may be forfeited without compensation if:-

  • More people than declared on the original booking attempt to take up occupation at the start of the holiday or occupy during any part of the holiday.
  • Overnight visitors are entertained without our express permission
  • Any activity which takes place which is illegal, may cause unreasonable damage, noise or disturbance
  • Guests smoke in the property
  • Guests bring pets to the property

COMPLAINTS
Every effort is made to ensure that you have an enjoyable stay. However, if you have any problem or cause for complaint, it is essential that you contact us immediately to give us the chance to resolve it. We value your custom and want you to return and will do our best to resolve any problem.

GENERAL
In the event that any individual term or clause stated in these Terms and Conditions of Let is not permissible by law, the remainder of the agreement shall remain valid.

If your payment has not been received 60 days before the commencement date we will assume that you wish to cancel. If the booking is made within 60 days of the arrival date then payment will be due in full.

No entry to properties will be allowed without payment, in full, being cleared beforehand.

CANCELLATION
Cancellations must be immediately notified to us by email.

If you cancel up to and including 2 days before the check-in date, you will receive a full refund of the accommodation costs you have paid. Refund payment for cancelled bookings will be released back to you within seven days of the original departure date. Cancellations made 1 day prior to, or on the day of check-in will not be eligible for refund.
Example: for a check-in on Friday you could cancel the prior Wednesday before 16.00 and be reimbursed in full, but not on Thursday (1 day prior) or Friday (day of check-in).

We strongly recommend that Guests take out travel insurance to cover their cancellation and other risks.

Terms and Conditions of Letting for Mornacott Cottages effective for all bookings made prior to 18th June 2020 and for those made after 18th June 2020 with an arrival date prior to 1st August 2020.

COVID-19 UPDATE (as at 24.5.20)
Notwithstanding anything contained within the terms and conditions below, and recognising that the majority of travel insurance policies now exclude cancellations due to Government lockdowns relating to COVID-19, we are guaranteeing a full refund of both deposits and final payments on all bookings made after 23rd May 2020 in the event that holidaymakers are unable to travel to us due to Government restrictions.

We can accept no responsibility for personal injury to the Guest and/or his/her invitees (known as the Holidaymakers) or loss of or damage to their property.

This agreement is made on the basis that the property is to be occupied by the holidaymakers for a holiday as mentioned in the Housing Act 1988 Schedule 1 paragraph 9 and the Holidaymakers acknowledge that the tenancy granted by this agreement is not an assured tenancy and that no statutory periodic tenancy will arise when it ends.

A non-refundable deposit of 25% of the cost of the holiday must accompany the booking. The full balance shall be paid no later than 90 days prior to the date on which the booking is due to commence. For bookings made within 90 days of the holiday a payment of 100% of the cost of the holiday is required at the time of booking.

We reserve the right to re-let the holiday in the event that the full balance remains unpaid more than ten days after the due date. In the event that we are unable to re-let the holiday then payment of the full balance remains the responsibility of the holidaymaker. We always recommend that holidaymakers purchase a travel insurance policy which provides suitable cancellation cover for their needs. In the event of the accommodation becoming unavailable as the result of damage or accident (such as fire or flooding or similar), we will endeavour to provide the holidaymakers with suitable alternative accommodation or will refund all monies paid or a proportion, in the case of curtailment. We cannot however pay any compensation or expenses as a consequence of such an event.

Bookings cannot be accepted from persons under the age of 18 years and single sex parties are not allowed unless special arrangements are made with the Owners and these arrangements confirmed in writing.

No bookings are valid until they have been confirmed in writing by the Owner. The Holidaymakers shall keep the property and all furniture, fittings and fixtures in or around the property in the same state of repair as at the commencement of the holiday. All breakages and damages must be reported to us and paid for during the holiday.

The cottage may only be occupied by the maximum numbers shown in the “sleeps” section under each cottage. Up to two infants (under two years of age) may also be accommodated in addition to these numbers. All holidaymakers must sleep in the beds provided and no temporary “camp beds” or inflatable mattresses are permitted.

Holidaymakers shall leave the property in a clean and tidy condition at the end of their holiday. We, or our representative, shall be allowed access to the property at any reasonable time during any holiday term. If a complaint should arise we should be informed immediately and allowed to investigate and take appropriate action.

The Booking Conditions apply to all confirmed bookings.

The Holidaymakers right to occupy the property may be forfeited without compensation if:

  1. More people than declared on the original booking attempt to take up occupation at the start of the holiday or occupy during any part of the holiday.
  2. Overnight guests are entertained without the Owner’s express permission.
  3. Any activity which takes place which is illegal, may cause unreasonable damage, noise or disturbance
  4. Holidaymakers smoke in the property.
